These Terms of Use ("Terms") govern your access to and use of Dictate. ("the app", "we", "our", or "us"), a voice keyboard application for iOS developed by Gabriel Alonso. By downloading, installing, or using Dictate, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the app.
We grant you a limited, non-exclusive, non-transferable, revocable license to use Dictate on any iOS device that you own or control, for personal or commercial purposes, subject to these Terms and the Apple Media Services Terms and Conditions.

Some features of Dictate require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate, current information during the sign-up process and to notify us promptly if you suspect any unauthorized use of your account.
Dictate offers optional paid subscriptions ("Dictate Pro") with monthly and annual billing options. By subscribing, you agree to the following:
Free features of the app remain available without a subscription, subject to usage limits.
You retain full ownership of all content generated through the app, including transcriptions, replacement rules, and any other user-created data. We do not claim any ownership or license over your content.
Audio recordings are transmitted to our servers solely for the purpose of transcription and are deleted immediately after processing. We do not store, retain, or use your audio for any other purpose.
You agree not to use Dictate to:
We reserve the right to suspend or terminate your access if you violate these Terms.
Dictate relies on third-party services to provide its core functionality, including speech-to-text transcription and text formatting. These services process your audio and text data according to their own terms and privacy policies.
We are not responsible for the availability, accuracy, or conduct of any third-party service. Changes to third-party services may affect the functionality of the app.
Some features of Dictate require an active internet connection. Transcription relies on external servers and will not function without network access. Certain features, such as reviewing transcription history and managing settings, are available offline.
We strive to provide a reliable service, but Dictate is provided on a best-effort basis. We do not guarantee uninterrupted, error-free, or continuous availability. We may modify, suspend, or discontinue the app or any feature at any time, with or without notice.
Scheduled maintenance and third-party service outages may temporarily affect the app's functionality.
All rights, title, and interest in and to Dictate, including its design, code, graphics, trademarks, and any related documentation, are owned by Gabriel Alonso. These Terms do not grant you any rights to use our trademarks, logos, or branding without prior written consent.
Dictate is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Gabriel Alonso shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of Dictate.
Our total liability for any claim arising from these Terms or the use of the app shall not exceed the amount you paid for the app or subscription in the twelve (12) months preceding the claim.
You may stop using Dictate at any time by deleting the app and, if applicable, canceling your subscription and deleting your account.
We may suspend or terminate your access to the app if you violate these Terms or engage in conduct that we reasonably believe is harmful to other users, third parties, or our systems. Upon termination, your license to use the app is revoked immediately.
If your subscription is canceled or your account is terminated, you will lose access to Pro features but your locally stored data (transcription history, settings, replacement rules) will remain on your device.
These Terms are between you and Gabriel Alonso, not Apple Inc. Apple is not responsible for the app or its content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
In the event of a conflict between these Terms and the Apple Media Services Terms and Conditions, Apple's terms shall prevail with respect to your use of the app as obtained through the App Store.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the effective date at the top of this page. Your continued use of Dictate after any changes constitutes acceptance of the new Terms.
